HIPAA (Health Insurance Portability and Accountability Act) regulates how protected health information (PHI) is stored, processed, and transmitted. For AI tools, there are three critical requirements:

A legally binding contract where the AI provider agrees to safeguard PHI. Without a signed BAA, no PHI can be submitted to the service. Most consumer AI platforms will not sign BAAs.

Critical Warning
Neither ChatGPT (Free, Plus, or Team) nor Claude (Free, Pro, or Max) are HIPAA-compliant. OpenAI and Anthropic do not sign BAAs for consumer plans. ChatGPT (Free, Plus, Team, Enterprise)
OpenAI does not sign BAAs for any ChatGPT plan as of July 2026. ChatGPT Enterprise offers data privacy guarantees (no training on your data) but still lacks a signed BAA. For HIPAA-covered entities, submitting any PHI to ChatGPT — even for "de-identified" analysis — is a compliance risk. The only OpenAI service that offers a BAA is Azure OpenAI Service through Microsoft.
Claude (Free, Pro, Max — Consumer Plans)
Anthropic signs BAAs only through enterprise agreements via Amazon Bedrock or direct enterprise contracts. Claude Pro ($20/mo) and Claude Max ($100/mo) are consumer plans with no BAA and no guarantee that data won't be used for training. Do not submit any PHI to the Claude web interface or API without a signed enterprise agreement.
Perplexity Pro, Gemini Consumer, Copilot Consumer
Perplexity, Google Gemini (consumer), and Microsoft Copilot (consumer) all share the same limitation: no BAA, no HIPAA compliance guarantees. Google Cloud Vertex AI is HIPAA-eligible, but the free consumer Gemini app at gemini.google.com is not. Similarly, Microsoft Copilot for Microsoft 365 doesn't sign BAAs — only Azure OpenAI does.
